These Terms of Service (“Terms”) govern the use of the website, customer area, hosting, cloud, backup, server, support and related IT services provided by Hostsecurecloud (“Hostsecurecloud”, “we”, “us” or “our”). By accessing our website, creating an account, placing an order, or using our services, you agree to these Terms.

2. Scope of services
Hostsecurecloud provides cloud, hosting, backup, server, software, support and related IT services as described on the respective product or service pages, order forms, offers or customer agreements. The exact scope, features, limits and pricing of a service are determined by the selected plan, package or individual agreement.
We may update, improve, replace or discontinue individual features if this is necessary for security, technical, legal or operational reasons, provided that the core functionality of the purchased service is not unreasonably impaired.
3. Customer account
To order or manage services, you may need to create a customer account. You are responsible for keeping your login credentials secure and confidential. All actions performed through your account are deemed to be performed by you unless you can prove unauthorized use that was not caused by your negligence.
You must provide accurate and current information and update your account details if they change. We may suspend or restrict access if account information is incomplete, incorrect or used in violation of these Terms.
4. Orders and contract formation
Service descriptions on the website do not constitute a binding offer unless expressly stated otherwise. A contract is formed when we accept your order, activate the service, confirm the order by email, or otherwise provide access to the ordered service.
We reserve the right to refuse orders, for example in cases of suspected fraud, abuse, sanctions restrictions, technical unavailability or incorrect pricing information.
5. Fees, billing and payment
Fees are displayed on the website, in the checkout, in the customer area, or in an individual offer. Unless stated otherwise, fees are due in advance for the selected billing period. Applicable taxes may be added as required by law.
You agree to provide valid payment information and authorize us or our payment providers to charge the amounts due. If a payment fails or becomes overdue, we may suspend or terminate services after reasonable notice, unless immediate suspension is necessary to prevent abuse, security risks or further losses.
6. Renewals, cancellation and termination
Services may renew automatically depending on the selected plan or subscription settings. You can cancel services according to the options available in the customer area or by contacting us before the next renewal date.
We may terminate or suspend services if you violate these Terms, fail to pay fees, use the services unlawfully, create security risks, or negatively affect our infrastructure, other customers or third parties. After termination, access to data and services may be removed. You are responsible for exporting or backing up your data before termination where technically possible.
7. Refunds
Refunds are granted only where required by law, expressly stated in the service description, or agreed individually. Setup fees, domain-related fees, licenses, custom work, administrative fees and already consumed service periods may be non-refundable unless mandatory law provides otherwise.
8. Acceptable use
You must use our services lawfully and responsibly. You must not use the services for:
- malware, phishing, botnets, credential theft or unauthorized access;
- spam, unsolicited bulk messaging or abusive marketing;
- copyright infringement or distribution of illegal content;
- fraud, scams, impersonation or misleading activities;
- attacks against networks, systems or applications, including DDoS attacks;
- hosting or transmitting content that violates applicable law or third-party rights;
- activities that overload, damage or disrupt our infrastructure or other customers.
We may investigate abuse reports and take appropriate action, including rate limiting, suspension, removal of content, termination, or reporting to competent authorities where required.
9. Security responsibilities
You are responsible for securing your accounts, applications, passwords, scripts, backup accounts and data unless a specific managed service states otherwise. You must keep software updated, use secure credentials and promptly inform us of suspected security incidents affecting our services.
10. Backups and data
Unless a service description expressly includes backup services, you are responsible for maintaining your own backups. Even where backup services are provided, backups may be subject to technical limitations, retention periods and restoration availability. You should regularly verify that your own backup strategy meets your business needs.
You retain ownership of your data. You grant us the rights necessary to host, transmit, process and store your data for the purpose of providing the services.
11. Availability and maintenance
We aim to provide stable and reliable services. However, interruptions may occur due to maintenance, updates, third-party providers, network issues, security incidents, force majeure or circumstances outside our reasonable control. Unless a separate Service Level Agreement applies, no specific uptime guarantee is provided.
12. Support
Support is provided through the channels described on our website or in the customer area. Support availability, response times and scope may vary depending on the selected service plan. We may refuse support for third-party software, unsupported configurations, illegal content or issues outside the agreed service scope.
13. Third-party services
Some services may depend on third-party providers, software, payment processors, domain registries, data centers or network operators. Their terms and policies may also apply. We are not responsible for interruptions or changes caused by third-party providers unless required by mandatory law.
14. Intellectual property
All website content, branding, design elements, documentation and software provided by Hostsecurecloud remain the property of Hostsecurecloud or its licensors unless expressly stated otherwise. You may not copy, modify, distribute or reverse engineer our materials except as permitted by law or by written agreement.
15. Limitation of liability
To the maximum extent permitted by applicable law, Hostsecurecloud is not liable for indirect damages, loss of profit, loss of business, loss of data, reputational damage or consequential losses. Nothing in these Terms excludes liability where such exclusion is not permitted by law, including liability for intentional misconduct or mandatory statutory liability.
16. Indemnification
You agree to indemnify and hold Hostsecurecloud harmless from claims, damages, losses and costs arising from your unlawful use of the services, your content, your breach of these Terms, or your violation of third-party rights.
17. Consumer rights
If you are a consumer, you may have mandatory rights under applicable consumer protection laws. Nothing in these Terms limits mandatory consumer rights that cannot legally be waived.

19. Changes to these Terms
We may update these Terms from time to time to reflect changes in services, legal requirements or business processes. The updated version will be published on this page. These Terms are governed by the applicable laws of Italy, unless mandatory consumer protection laws provide otherwise. The place of jurisdiction shall be determined by applicable law.
